TERMS AND CONDITIONS OF SALE, RETURNS AND WITHDRAWAL

These Terms and Conditions apply to all sales made through the following domains:

2. Subject of the Contract

These Terms and Conditions govern the online sale of collectible and gaming-related products, including but not limited to:

  • Trading Card Game (TCG) products

  • Single cards

  • Booster packs

  • Sealed boxes

  • ETBs, displays and bundles

  • Gaming accessories

  • Sealed products

  • Collectible merchandise

3. Acceptance of the Terms

By placing an order, the customer declares that they have read, understood and fully accepted these Terms and Conditions.

4. Eligible Customers

The following may purchase products from ONYTCG:

  • Private consumers

  • Companies

  • Professionals

  • Retailers, subject to seller approval where required

A consumer is defined as a natural person acting for purposes outside their trade, business, craft or profession.

5. Conclusion of the Contract

The sales contract is considered concluded when the customer receives the order confirmation by email or through the website's automated confirmation system.

Any automatic acknowledgment of receipt of the order does not constitute final acceptance in cases of:

  • product unavailability

  • technical errors

  • administrative checks

The seller reserves the right to refuse, cancel or suspend orders in the following cases:

  • incomplete or incorrect information

  • non-payment

  • suspected fraudulent activity

  • pricing errors

  • product unavailability

  • abusive customer behavior

In such cases, any amount already paid will be refunded.

6. Prices

All prices are displayed in Euro (€), unless otherwise specified.

Prices may be changed at any time; however, the price displayed at the time the order is placed shall apply.

In the event of an obvious, abnormal or manifestly incorrect pricing error, the seller reserves the right to cancel the order and issue a full refund.

7. Product Availability

Product availability is indicative and does not constitute an absolute guarantee of stock availability.

Simultaneous sales, inventory discrepancies or delayed stock synchronization may result in products becoming unavailable after an order has been placed.

In such cases, the customer may choose between:

  • a full refund

  • replacement with an equivalent product

  • waiting for restocking

  • Store Credit or another agreed credit solution

8. Pre-Orders

Certain products may be sold on a pre-order basis.

Release dates provided by publishers, manufacturers or distributors are indicative only and may be subject to change.

The seller shall not be held responsible for:

  • official release delays

  • logistical delays

  • reductions in allocated quantities by distributors

In the event of distributor allocations lower than expected, ONYTCG reserves the right to:

  • reduce the quantities available for purchase

  • fulfill orders in chronological order

  • offer a full or partial refund

9. Trading Cards and Sealed Products

Trading cards may present:

  • normal manufacturing tolerances

  • minor printing defects

  • minor surface imperfections

  • centering imperfections

  • slight factory warping

  • minimal cutting or finishing variations

Such characteristics, when consistent with industry standards, shall not be considered defects.

Product images are for illustrative purposes only unless explicitly stated to be actual scans of the item.

The random contents of booster packs, boxes and sealed products are determined exclusively by the manufacturer.

The seller does not guarantee specific pull rates, rarities or product contents.

Subjective grading evaluations shall not constitute valid grounds for returns or refunds.

10. Payment Methods

The following payment methods are accepted:

  • PayPal

  • Credit and Debit Cards

  • Bank Transfer

  • Scalapay

  • Stripe

Orders may only be shipped after payment confirmation, except for payment methods providing immediate authorization.

11. Gift Cards and Store Credit

ONYTCG offers digital Gift Cards and Store Credit that can be used on the websites onytcg.com.

Gift Cards are delivered exclusively in digital format via email and do not involve the shipment of any physical product.

Gift Cards and Store Credit may be used to purchase available products and pre-orders, unless otherwise specified on the product page.

Gift Cards and Store Credit may be used across one or multiple orders until the available balance has been exhausted.

Unless otherwise specified at the time of issuance, Gift Cards and Store Credit do not expire.

Any remaining balance will remain available for future purchases.

Gift Cards and Store Credit cannot be redeemed for cash unless otherwise required by applicable law.

The remaining balance of Gift Cards and Store Credit can be viewed by logging into the customer's account and accessing the "My Credit" section.

12. Anti-Fraud Checks

To protect both customers and the seller, certain orders may be subject to manual verification.

The seller reserves the right to request confirmation of customer information or to cancel suspicious orders.

13. Shipping and Delivery

Shipments are primarily made through:

  • UPS

  • BRT

The seller may also use equivalent shipping carriers when necessary.

Shipping costs and estimated delivery times are displayed during checkout.

Delivery times are estimates only and may vary due to circumstances beyond the seller's control.

Customers are required to inspect the package upon delivery.

Any visible damage must be reported immediately to the carrier and communicated to info@onytcg.it within 48 hours of delivery.

The risk of loss or damage to the products passes to the consumer upon delivery.

14. Right of Withdrawal

Consumers residing within the European Economic Area (EEA) have the right to withdraw from the contract within 14 days of receiving the goods, without providing any reason.

For orders delivered in multiple shipments, the withdrawal period begins upon receipt of the final item.

To exercise the right of withdrawal, the consumer may:

  • use the dedicated "Request Withdrawal" digital function available on the ONYTCG website;

  • send an explicit request to info@onytcg.it;

  • send a written communication to:

The request must contain sufficient information to identify both the customer and the order concerned.

Where the withdrawal request is submitted through the digital withdrawal function, ONYTCG will provide without undue delay a confirmation of receipt on a durable medium (such as email), including the date and time of the request.

15. Return of Products

ONYTCG will provide customers with instructions for returning products.

Returned products must be:

  • intact

  • complete with all accessories

  • properly packaged

  • unused beyond what is necessary to inspect their nature and characteristics

  • accompanied, where possible, by the relevant order reference

For sealed products (including booster boxes, displays, starter decks, bundles and similar products), returns are accepted only if the product remains sealed and intact, except where opening was necessary to verify a lack of conformity or defect.

16. Exclusions from the Right of Withdrawal

The right of withdrawal may be excluded in cases provided by law, including:

  • customized or personalized products

  • sealed products that have been opened where applicable law excludes the right of withdrawal

  • products damaged by the customer

  • incomplete products

  • products used beyond what is necessary to establish their nature, characteristics and functioning

Consumer rights relating to defective or non-conforming products remain unaffected.

17. Return Shipping Costs

The cost of returning products is borne by the customer, except in cases involving:

  • an error attributable to the seller

  • incorrect products supplied

  • defective or non-conforming products

  • a different written agreement between the parties

The use of a tracked shipping service is strongly recommended.

ONYTCG shall not be responsible for lost returns sent without tracking.

18. Refunds

Once the returned products have been received and inspected, refunds will be processed within 14 days.

The seller may withhold the refund until the returned goods have been received or until proof of return shipment has been provided, whichever occurs first.

Refunds will be issued using the same payment method used for the original transaction unless the consumer has expressly agreed to a different refund method.

Where required by applicable law, the refund will also include the standard shipping costs originally paid by the consumer.

As an alternative to a refund through the original payment method, the customer may voluntarily choose to receive ONYTCG Store Credit or an ONYTCG Gift Card equal to the value of the refund due.

Store Credit may be used for future purchases on onytcg.it and onytcg.com.

Acceptance of Store Credit or a Gift Card is entirely voluntary and does not affect the consumer's statutory rights.

Unless otherwise specified at the time of issue, ONYTCG Store Credit does not expire.

In the event that an order or pre-order is cancelled due to product unavailability, distributor allocation reductions or other circumstances beyond ONYTCG's control, the customer may choose between:

  • a refund through the original payment method;

  • the issuance of ONYTCG Store Credit of equal value.

Refunds may include:

  • the price of the returned product;

  • the cost of the original standard shipping service, where required by law.

Additional costs relating to premium shipping services, express delivery options or optional services selected by the customer shall not be refunded.

19. Legal Warranty

Consumers are entitled to the legal warranty of conformity provided by applicable Italian and European consumer protection laws.

In the event of a lack of conformity reported within the applicable legal time limits, the consumer may be entitled, where applicable, to:

  • repair of the product;

  • replacement of the product;

  • price reduction;

  • refund.

Nothing in these Terms and Conditions shall limit the consumer's statutory rights under applicable law.

20. Limitation of Liability

The seller shall not be liable for:

  • delays attributable to shipping carriers;

  • force majeure events;

  • temporary unavailability of the website or related services;

  • indirect damages, consequential damages or loss of profits, except in cases of willful misconduct or gross negligence.

Nothing in these Terms and Conditions shall exclude or limit any rights that cannot be excluded under applicable consumer protection laws.

21. Intellectual Property

All trademarks, logos, images, texts, graphics and other content displayed on the website are the property of their respective owners.

Any reproduction, distribution, modification or unauthorized use of such content is strictly prohibited.

22. Privacy

Personal data is processed in accordance with the Privacy Policy published on the website and in compliance with the General Data Protection Regulation (GDPR) and applicable privacy laws.

Customers are encouraged to review the Privacy Policy available on the website for further information regarding the collection, processing and protection of personal data.

23. Governing Law and Disputes

These Terms and Conditions and any contracts concluded through the website shall be governed by Italian law.

For disputes involving consumers, jurisdiction shall lie with the court of the consumer's place of residence or domicile, where required by applicable law.

Customers are encouraged to contact the seller at info@onytcg.it before initiating legal proceedings in order to seek an amicable resolution of any dispute.

24. Digital Withdrawal Function

ONYTCG provides consumers with a dedicated digital withdrawal function called "Request Withdrawal".

This function allows consumers to submit their withdrawal request directly online.

Following the submission of the request, the consumer will receive, without undue delay, confirmation of receipt on a durable medium, including the date and time of the request.

The digital withdrawal function is made available through the methods and sections indicated on the ONYTCG website.
